Sadly, courts take the position that if you don’t agree with the terms, don’t buy the product. Even in the cases where you couldn’t access the terms ahead of the sale.
I’m pretty sure forced arbitration is in fact legal and enforceable in the US (at least for the most part? I am not a lawyer)
